Additional advantages of engaging the services of an independent contractor, as opposed to an employee, include the following:
You are not required to pay unemployment insurance taxes. (Internal Revenue Code § 3306(c)(i); Unemp. Ins. Code §§ 675, 976; Unemp. Ins. Code §§ 135, 2602(a);
You are not required to pay Social Security (FICA) taxes. (Internal Revenue Code § 3111.);
You do not need to withhold taxes from compensation. (Internal Revenue Code §§ 3102, 3401(a); Unemp. Ins. Code § 13020; see Unemp. Ins. Code §§ 13005, 13009.);
You are generally not liable for the torts of an independent contractor. (Van Arsdale v. Hollinger (1968) 68 Cal.2d 245, 250-252.);
The relationship with the independent contractor may be terminated for reasons specified in the agreement. (Mountain Meadow Creameries v. Industrial Accident Commission (1938) 25 Cal.App.2d 123, 127.); and
The employer need not furnish tools, instrumentalities, or a work place for the independent contractor.
